This is the official site ("Site") of HookSpace Technologies Private Limited ("Company"), a company duly incorporated under the laws of India, and other sites linking to these Terms of Use, including mobile versions of such sites (collectively, the "Sites" or, individually, a "Site").

This Site is an online portal that allows organised interaction with social media influencers. This Site brings together companies/individuals who are seeking valuable inputs, recommendations and endorsements on specific brands/topics and bloggers/individuals/social media influencers who are willing to provide such inputs.

HookSpace can be used by digital marketing companies, brands, and PR agencies for identifying the right influencers who could potentially promote their brands, products or services.

HookSpace is also a platform for influencers (people with substantial presence on social media platforms like Facebook, Twitter, Instagram, YouTube, etc., who have large followers or subscribers) who wish to monetise their digital presence by listing through HookSpace, so that their social media presence can be commercially benefited by endorsing and commenting on brands that they prefer.

The Site is thus a marketplace for digital marketing companies, brands, PR agencies, and influencers.

Definitions

• "Services" — any services offered on or through the Site to a guest or registered user.
• "User" — digital marketing companies, brands, individuals, PR agencies, and influencers.
• "Influencer" — persons active on social media with substantial followers/subscribers who have the ability to influence other users, included in HookSpace database as registered or unregistered influencers.
• "Registered Influencer" — those who have volunteered to provide personal details and registered as an influencer.
• "Content" — any inputs on brands/topics including text, reviews, comments, data, images, photographs, music, sound, video or any other material.
• "Personal information" — any information relating to the user including name, email, phone number, location, gender, IP address, address, photograph and economic, cultural or social identity.

Eligibility

By using the Services, you represent and warrant that you are above 18 years of age and qualified to enter into a contract. If you are not eligible, please discontinue use and leave now.

If you are the parent or guardian of a child under 18, by creating an account you provide consent to your child's registration and agree to be bound by these Terms. You warrant that you have the legal capacity to enter into this agreement.

Terms of Use

Please read these terms and conditions carefully before using the Services. They form the entire agreement between you (referred to as "You", "your", "User" or "Influencer") and HookSpace ("we", "us").

This Terms of Use applies to all registered and unregistered influencers listed in the HookSpace database. By creating an account, accessing the Site, or acquiring subscriptions, you accept these Terms without modification. If you do not agree, you may not use the Services or create accounts.

By using HookSpace, you acknowledge that you are willing to interact with brands, advertisers, and marketing agencies. As an influencer, you may receive requests from brands asking you to support brand promotions through social media postings in return for fees. You have the liberty to accept or refuse these requests. HookSpace is merely a medium (intermediary) to connect.

We do not provide any assurance about brands, advertisers or marketing agencies. You understand that HookSpace (a) collects your data/personal information from social media platforms, (b) monetises content and information through APIs and web crawlers, and (c) showcases your ability and creativity to brands and agencies.

If we verify your background and identify you as "Verified", such notation means only that you completed a verification process and shall not constitute an endorsement. Unregistered influencers whose details are sourced from public sources may contact us at contact@hookspace.in to remove or correct their information.

This Site is made by an Indian company for Indian customers. If you are from another country, HookSpace may not have complied with your country's laws. You use this site knowing this limitation. You are solely responsible for compliance with applicable laws and for all content you post.

Operation of the Services may involve transmissions over networks and to third‑party vendors. We have taken reasonable security measures but give no assurance against unauthorised access, corruption or loss of content.

This Site may contain links to other websites with their own terms. We are not responsible for external links or their content. Use of cookies is explained in our Cookie Notice. We reserve the right to use your name for marketing or promotional purposes.

By providing information through the Site, you agree to receive communications from us via email, SMS, phone, and other means regarding features, updates, and platform information.

HookSpace Profile

To collaborate with brands, you may join HookSpace by creating a profile. When registering as a Registered Influencer, you will be required to provide personal information including full name, email, phone number, gender, age, location, area of interest, and connect your social accounts. Information must be accurate and complete. We may refuse access if details are incorrect or incomplete.

Once your profile is complete, you will be notified that you have become a Verified Influencer. The profile is typically activated within 24–48 hours. If not activated within 48 hours, notify us at contact@hookspace.in.

You will be notified when a marketer/brand is interested in collaborating. It is solely your discretion to accept or refuse invitations. You may improve your profile with details such as rates and previous collaborations.

Guidelines for Registered Influencers

• Profile shall accurately represent experience, skills and personal information
• Profile photos shall be clear and appropriate; heavily manipulated pictures are prohibited
• Each influencer shall have only one account; no sharing or duplication
• No falsely implying a relationship with the Company or any advertiser
• Spam is strictly prohibited
• No negative, defamatory, abusive or false communications about the Company, advertisers or campaigns in any media

We reserve the right to remove, suspend or restrict access to the platform for violations of these Terms, harmful conduct, or objectionable content. You may cancel your account at any time.

Right to Use

HookSpace grants you a non‑exclusive, non‑transferable, revocable, limited right to use the data on the Site for personal and commercial use. You have the right to know when brands or agencies shortlist you. However, we are not responsible for your interactions or agreements with other users or brands.

License Restrictions

You shall not: defame, harass or threaten; publish offensive, defamatory or unlawful content; infringe intellectual property; transfer your account; distribute spam; use automated systems to access the platform without approval; impersonate others; engage in illegal activity; share material linked to terrorism or weapons; violate applicable laws; or threaten India's unity, integrity or security.

This license terminates automatically upon violation. We may alter, suspend or discontinue any aspect of the Services at any time.

Permitted Uses

By using the Services, you permit us to: use and retain your data (video, photo, written or verbal content) on HookSpace; share your data with users for marketing campaign purposes; contact you via email, phone or public social media; prioritise and filter the database for campaign objectives; paraphrase or adapt your statements and feedback; use your name for marketing; refuse services, terminate accounts or remove content at our discretion.

Changes to the Terms are effective upon posting. HookSpace does not claim ownership of your User Content. You are responsible for costs incurred while using the Site. We do not knowingly collect data from persons under 18.

Use of Content

Your right to use the Site and Content is subject to compliance with these Terms. Information about brands and agencies is provided as‑is; we have not verified its veracity or accuracy. We make no guarantees about the existence, quality, legality or accuracy of Content. We do not endorse any particular User or Content.

By using the Site, you assign to the Company the right to use, reproduce, republish and create databases based on data you provide. The Company may use, exploit and utilise Content worldwide and in perpetuity. You grant a non‑exclusive, worldwide, perpetual, irrevocable, royalty‑free, sub‑licensable license to the Company for the Content. We may modify Content to transmit or adapt it for technical requirements. We do not guarantee accuracy of any Content. The Company may discontinue services and abandon the user database without direct intimation.

Retention Policy

We retain personal data as long as necessary to fulfil the purposes described in our Privacy Policy. Registered Influencers may correct or delete data until removed. Unregistered Influencers may request correction or deletion by writing to contact@hookspace.in (subject to identity verification). We retain some data for the life of your account for improving Services. We may retain data longer for tax, accounting, security, legal or regulatory purposes.

Electronic Communications

Visiting HookSpace, sending emails, and using the Site constitutes electronic communications. You consent to receive electronic communications and agree that all agreements, notices and disclosures provided electronically satisfy any legal requirement that such communications be in writing.

Privacy

Your use of HookSpace is subject to our Privacy Policy. By accepting these Terms, you also accept the Privacy Policy.

Third‑Party Sites

The Site may contain links to other websites. HookSpace is not responsible for linked sites. Inclusion of a link does not imply endorsement. HookSpace may share information with third‑party service providers to deliver requested products or services.

Indemnity

We provide a platform for you to connect with brands and agencies. Information on the Site is provided "as is" by users. You are solely responsible for your interactions and any liability arising from your Content. You indemnify and hold harmless the Company from any losses, claims or damages resulting from your breach of these Terms, infringement of rights, or misuse of the platform. You are solely responsible for your Content and assume all risks.

Intellectual Property Rights

The Site and materials (text, graphics, images, logos, software, etc.) are protected by copyrights, patents and trademarks owned by or licensed to the Company. Using our Services does not give you ownership of any intellectual property. You may not copy, modify, distribute or use Materials without authorization. Decompiling or reverse engineering software is prohibited.

User Warranties

By creating a profile and providing information, you warrant that: you own or have necessary rights to grant us rights in User Content; all information is accurate and does not violate third‑party rights or laws; you consent to communications via email, SMS, phone and other means; you will monitor your Content; you will not create misleading Content; and your User Content does not infringe any third‑party intellectual property or violate any law. HookSpace may exercise editorial functions on User Content. You will not disclose confidential information of HookSpace.

Disclaimer of Warranties

HookSpace does not have any association or contract with Facebook, Instagram, Twitter, YouTube or other social media platforms. We merely provide a platform to connect with other users. We do not advise or guide you on transactions with users or third parties. We do not verify legality of your transactions. HookSpace is not a party to any agreement between you and another user. The Services are provided "as is" and "as available" without warranties of any kind. The entire risk is borne by you. We use public data and third‑party information; we make no warranty regarding accuracy, timeliness, uninterrupted access or error‑free operation. We do not guarantee compliance with laws of any country. You download or access materials at your own risk.

Limitation of Liability

To the maximum extent permitted by law, the entire risk arising from your use of the platform remains with you. Neither HookSpace nor its affiliates, officers, directors, employees, partners or agents will be responsible for lost profits, revenues, data, or indirect, special, consequential or punitive damages. In no event shall our aggregate liability exceed the amount you paid us to use the Services. No advice or information obtained from us shall create any warranty not expressly stated.

Jurisdiction and Dispute Resolution

These Terms are governed by the laws of India. You consent to the exclusive jurisdiction of the courts of Bangalore, India. If any provision is unenforceable, the remaining provisions remain in effect. Any dispute shall be referred to and finally resolved by arbitration in Bangalore under the Indian Arbitration and Conciliation Act, 1996.

Affirmation

By creating a profile or using the Services, you acknowledge that you have read this entire Agreement and agree to be bound by all its terms and conditions.
